Professional Profile

Ms. Lan Li specializes in providing clients with a full range of intellectual property legal services, with rich experience especially in the dispute resolution of trademarks, trade secrets, unfair competition, patents, copyright, and domain names. Ms. Li handled many Model Cases and Top Ten Cases of the Supreme People's Court or local courts, including the case of trademark infringement and unfair competition for a famous lingerie brand, which was selected as one of the 50 Model Intellectual Property Cases in Chinese Courts in 2015, the Top Ten Cases of Judicial Protection of Intellectual Property in Shanghai Courts in 2015, and the Cases in the Bulletin of the Supreme People's Court. Ms. Li also handled several cases that were selected as QBPC (Quality Brand Protection Committee of China Association of Enterprises with Foreign Investment) Top Ten Cases of IPR Protection of the year. Ms. Li also provided effective legal advice and counseling for a multinational company and successfully obtained the first trade secret protection injunction in China, and successfully obtained the first trade secret preliminary injunction in Shanghai IP Court for a client in another technical secret infringement dispute.

Partial Representative Case

Advised a US pharmaceutical company on legal action against its ex-employee in trade secret theft resulting in the first preliminary injunction order in trade secret litigation in China. The case was listed in the Top Ten IP Cases by the Supreme People’s Court.

Advised a US pharmaceutical company in a trade secret parallel proceeding between the US and China resulting in the first preliminary injunction order before the Shanghai IP Court, and ultimately reached a favorable settlement.

Defended a US electrical appliance company in trademark infringement and unfair competition litigation against a major Chinese competitor before the Supreme People’s Court of China resulting in a rare reversal and subsequent retrial dismissing all the claims.

Defended a US company operating the main professional golf tour in a contract dispute against a Chinese company before the Supreme People’s Court of China and obtained a full retrial order, which is a very rare result.

Advised a US retailer of lingerie in a legal action against a Chinese company which operated “fake stores” selling authentic products in 20 cities in China resulting in a favorable judgment declaring trademark infringement and unfair competition.

Advised a Finnish communications and information technology corporation on various trademark and design patent infringement matters in Shanghai and Guangdong.

Advised a US home appliance manufacturer to enforce its patent against a number of infringing manufacturers in China through court, custom, and invalidation proceedings.

Advised a US chemical manufacturer in the defense of a patent infringement lawsuit in China resulting in a favorable final judgement dismissing all the claims.

Advised a French luxury brand in complex commercial contract dispute lawsuits in Guangdong resulting in a favorable settlement agreement.
